Default Re: Walking Out of a Store After Getting Caught Switching Price Tags

Ok...now that I am not juggling 10 things at once.

Disclaimer: I'm not psychic, so....this is all what can happen.

This here has a lot of info for you. http://www.criminaldefenselawyer.com...harges-florida

Statute of Limitations...depending on how much you stole....2 years. 3 if you are on Felony level.

    Tips:
    - Stay out of Macy's.

    - I assume like many Macy's, this one is in a mall. Avoid that mall.

    - Do your research on criminal defense lawyers. Many offer free consultations, so not a bad idea to go talk to a few. Because you may be sitting at home one day and get a knock at the door from the police with a pair of shiny silver bracelets....OR you just may get a court date in the mail.

    - You may luck out and get a Civil Demand Letter in the mail from the store/it's lawyers. Sometimes just paying it off (in Florida, up to triple damages) may result in no criminal charges....there is no guarantee that if you pay it, you won't get criminal charges, but it really increases the odds they won't (IF they already haven't). And in my case, my lawyer had me present my receipt for the Civil Demand to the judge to show I was taking responsibility....

    - I can't find exactly how long a conviction will stay on your record in Florida. For Michigan, it is 5 years before you can file for an expungement of the record, and the time to get a court date. Some states do not have expungement at all. Fill out a job application lately? "Have you ever been convicted of a misdemeanor?" Checking yes, then explain the charge...= kiss that job goodbye. (if you are looking for a new apartment, a crime of moral turpitude can mean "kiss that apartment goodbye"). Got a professional license? Your crime may be reported to the Department that handles professional licensing... (DBPR in Florida, I believe?)

Again, I can't stress this enough: Be honest with your lawyer. A lawyer who believes in you and likes you is gonna work harder for you. A lawyer you lied to is just not gonna care as much....

    - If you need a lawyer....another good idea is Shoplifters Anonymous. Anti Shoplifting Classes.

    - Be honest with the judge. You lie to the judge, oh boy, you're really screwed.....

So frankly...."I changed the price tags on 10 items in Macy's, but it was my first time, I swear" = "LIE" And here is why. You went into different dressing rooms. You changed the tags on not 1, but 10 items. (this can make your charge worse because it shows you planned it). You knew how to get a tag off and replace it....and brazen enough to do it with 10 items in 1 day in 1 trip to 1 store....and switch cashiers when the first one got suspicious. You have done this many times before. That, and the value of merch...believe me, the Prosecutor and Judge have heard it....And again, in court, video of you will be shown....your lawyer can ask for discovery and see how bad your case will be....
