    Default Daughters' Last Name

    Hello, My wife up and left with no warning in Jan. 05. 5 months later she called and told me she was pregnant and that she was in New York. The baby is mine, this has been established. I received a medical bill and it showed that my wife (we are now legally separated as of October 05') gave our doughter her maiden name. She has this name on her birth certificate and social security, etc. Is this legal? Do I have a right to change her last name to mine? I was not there for the birth, I came up a week later. So I did not have the opportunity to sign anything. Not sure if that plays a role.

    Take her back to court in the same lawsuit and ask that the kid's name be changed.

    We never actually had a court proceeding. The separation agreement was written up by a lawyer in Syracuse, NY. So, I guess then I need to initiate a court proceeding on the subject through my lawyer? Thanks for your help!
