My question involves labor and employment law for the state of: Virginia

I was employed for years and was terminated in early October. I started collecting unemployment and started looking for a job. After a few weeks I kind of sort of took a job with a really big package delivery company as a truck driver/package delivery person. I understood the position was temporary and there was a training period. After 2 days in my knees hurt so bad that I could not walk more than a few steps. I called into the company on my 3rd day and told them I could not come in. Since this was the last training period before the holiday rush they did not offer to keep me on but did not terminate me either. I really do not care about that and am not contesting that. A few weeks later I received a letter from the VEC (Virginia Employment Commission) who pays Unemployment benefits and they cut off my benefits because I quit a job.

I never accepted a job, I never signed a thing (I-9, W-4, offer letter, nothing). I showed up for a training/orientation class and left due to the pain in my knees. My first day of training I asked if I was getting paid but was never given an answer, just told that when I started driving a truck that I would be making good money. Three weeks after I showed up for the 2 days of training I got a check from the company for time worked.

The VEC had a telephonic hearing and I participated by the employer did not. I stated everything factually and today I got a letter saying that I quit my job and did not seek medical treatment from a licensed physician (duh, I didn't have any money or insurance because I didn't have a job). Now they are coming after about $1800 that they paid after I "quit" a job that I never knew that I had. In addition the benefit stopped so I missed out on another $1200 or so that I would have gotten up until I started my current job. My question is this- Do I fight this again? Is the burden of proof on me or the VEC to prove whether or not I was employed? Should I see a lawyer? Thanks.

And btw - a guy that got fired at the same time as me has sat on his butt the whole time and not had a problem collecting unemployment. I on the other hand have landed 2 jobs and now they are gonna take a bunch of benefits back from me....I know it isn't relevant to my case- but it makes me
