    Unhappy Wrongful Termination of a Freelancer With No Contract

    My question involves labor and employment law for the state of: NY

    I had been working for a non-profit cultural foundation as a freelancer with no contract for nine months when I was unexpectedly notified that my services had to be discontinued. The notice claimed that as the father of a public school first grader I "ferried pathogens" that jeopardized the elderly Director health on two occasions. Does any legal recourse exist?

    To do what?

    If you are an employee, this is not a wrongful termination as defined by law. If there is no contract, there cannot be a contract breach. So the legal recourse I see is to apply for unemployment.

    if you were correctly designated as an independant contractor you do not have protection from discrimination http://www.eeoc.gov/employers/coverage.cfm
