    Default Ex-Roommate Says She Won't Return My Share of the Security Deposit

    My question involves landlord-tenant law in the State of: Tennessee


    So I rented a 2 bedroom apartment in Bellevue Nashville tennesee with my ex room mate last January.
    After a couple months , 4, to be exact. I moved out.
    To make it easier on my room mate I just moved out without telling the leasing office so my name is still on the lease..
    So she's been living there without me but my name is still on the lease.
    The lease is up in March and I was expecting my half of the deposit to be sent back to me . But I called the office and they said one check will be sent out to the head of the household and we will have to decide who gets what. My ex room mate is the head of the household and she told me I don't deserve the deposit I put down because I walked out on the lease so she refuses to send me my half. And the leasing office says they can't do anything bout it.: so I don't know what to do! Is there anything I can do or am I screwed out of 600 dollars?

    Have you continued to pay rent on this lease?

    No. From what I heard she has someone living there part time under my name paying. And my ex room mate has been paying most of it.

    You need to find out if someone has taken over your share of the lease.

    If not and your ex-roommate has been paying all of the rent, be glad you might be losing just your deposit. She could turn around and sue you for your share of the rent she has been paying all these months since your name remains on the lease.

    You could certainly sue for the deposit. You will need to prove that you paid it and fulfilled all the conditions in place at the time you entered into the lease, entitling you to return of the deposit. You should also have pictures showing the condition of the property at the end of the lease, showing that no damage was done to the premises during your tenancy.
    As Gail mentioned, that will probably encourage your ex-roommate to take the opportunity to counter-sue you for non-payment of rent and perhaps other expenses.
    I'd walk away, considering it a gift from the ex that she allowed you to leave without requiring that you fulfill your contract.
