    Default Constant Trespassing Issues with Neighbors

    My question involves criminal law for the state of: Nebraska

    Would a cease and desist request be of any help in this instance?

    I realize that many people will think I'm being silly but I am so tired of the neighbors constantly trespassing on my property, mainly because I have to re-landscape my front yard due to the constant trespassing. One neighbor even drove their vehicle across my front yard. I do have a "Private Property: No Trespassing" sign posted but it doesn't help. Now, the tenants in the house across the alley from me are letting their six kids play in everyone's yard. They are even climbing on a neighbors fence which is on the point of falling down. The kids have even been throwing rocks at my van. Considering that I keep finding all manner of dangerous objects in my yard (broken glass, rusty nails, sharp pieces of metal, etc), I don't want the kids getting hurt and end up getting sued by the parents. Yesterday, I caught the kids in my yard and told them to leave, after taking photos of course. Today, they were back so I went to their house to talk to their parents. Long story short, I was threatened, falsely accused and told the section of my property from the fence to the ally was public property. I would prefer not to have anything to do with my neighbors since several years ago, one family renting the house next to mine terrorized me to the point where I was a prisoner in my own home for six months. I did call the police today but, of course, they won't do anything. I will start taking my voice recorder and my pepper spray with me every time I leave the house. I can't find a number for the landlord to let them know I had to call the police but if I do go with a cease and desist order, I will send a copy to the landlord, though I know it will not do any good.

    It is unfortunate that our society has evolved into one where property rights have to be defended instead of being respected. Go talk to an attorney to find out what can be done.

    id get some security cameras set up,, get them on tape throwing stuff at your car,, so you can show the police, once you got proof like that, its really easy to get some results

    I wish I could get an attorney but since I was laid off early last year, I've only been able to get a part time job that doesn't leave any extra money for an attorney. That's why I'm going this route to get suggestions on what to do.

    I own my property and I do have insurance that will pay for someone getting injured on my property. However, these particular tenants do not know what truth is. Even after I told the mother I had photos of her kids on my property, she still denied they were ever on my property. I'm sure if the kids get hurt messing around in my yard, they'll find a way to make the injuries look more severe than they are.

    The only thing I can suggest is to reach out to the landlord and ask that they have a talk with their tenants. If someone gets hurt in the meantime, let your insurance company defend you. That is what you pay them for.

    I did find out who owns the property (thank you, county website) but the number is unlisted. I'm debating on writing a letter. I'm also thinking about calling child services. The kids are allowed to play outside in below freezing weather in shorts and t-shirts and in the streets. There is a lot of traffic in this area and most drivers go 50-60 in a 25. They are often left home alone as well.

    The tenants will only tell their landlord I'm lying and that I have a mental condition. The mother told me she heard that from the other neighbors which is why she hasn't confronted me with cussing at her kids and turning the hose on them, neither of which I did. And I didn't realize that I had a mental condition until today. I thought expecting people to obey the law and be considerate of others was normal.

    Make sure you send the letter via the USPS certified mail as well as First Class mail.
