    Default Non-Customers Putting Their Garbage in Other People's Trash Bins

    My question involves business law in the state of: ohio
    My husband and I own and operate a residential garbage business. We have been having issues with people putting their garbage out with paying customers, and basically getting something for nothing. What legal recourse if any do we have?

    Disregard my last post as I misread your question.
    You are saying you pick up garbage for residential customers, and other people (who are not paying customers) are putting stuff on the piles of paying customers. That right? If that's correct, the problem is between your clients and those trespassing on their property and dumping stuff.

    Your clients can make a report about this to the police, and there are probably municipal ordinances against it.

    That being said, if we are talking about people throwing their McDonald's bag and wrappers in someone else's garbage can, don't expect it to go very far. I hope you're talking about people dumping commercial levels of trash, old pallets, etc.

    Do a trash audit and identify the offenders. Then send them a bill. If they don't pay, follow up with a few dunning letters, then sue them in small claims court.

    They'll get the idea.

    how can you tell the other peoples trash apart? seems like that would be a hard thing to do

    You open the bags up and look for names and addresses on bills, statements, magazines, receipts etc.

    1. Are we talking about garbage cans or dumpster's?

    2. How do you charge your customers?

    3. What if the garbage can/dumpster is overloaded, do you add a charge to your customer for that?

    4. How much are you suspecting is being dumped?

    I know of some company's that make their customers buy stickers for there garbage bags. They charge $1.00 a sticker and every bag of garbage the customer places in the garbage can/dumpster, the customer will place a sticker on it. If a bag doesn't have a sticker, the collector doesn't take the bag.
