    Default Single Mom Getting Married Wants to Move Out of State

    My question involves a child custody case from the State of: Florida

    My son is engaged to a single mom in Florida, he lives in South Carolina, he works as a FF/EMT and his fiancé is going to school. He wants her to move up to SC and finish school but her ex-boyfriend does not want her to leave Florida with their 3 year old son. The ex is not on the birth certificate but does pay the child's day care expenses and sees him once or twice a week. It appears that if he wants to push the issue and establish paternity she may have to stay in FL, is that correct? Does she have any legal rights since he has not established paternity until now (he is married to another person but was separated at time of birth)? She is afraid the courts will give him 50/50 custody and will not be allowed to move out of state and continue going to school with the help of my son. If they were married would this help or complicate matters? Would the ex be required to back pay child support for the last 3 years? How much would my son and his fiancé look at spending to fight this in court?

    I appreciate any advise.

    But here's the solution: Mom gives custody of Junior to Dad and then she can move where-ever she wishes and pay Dad child support.

    He sees him once maybe twice a week. The ex does not want custody of the little guy and the mother does not want to leave him, she is trying to finish school and by moving this will allow her to focus on school full time instead of part time with my son's work schedule and support.

    Then she needs to get a court order allowing her to leave. She should expect to pay transportation expenses.
