    Default How to Press Charges for Credit Card Fraud

    Hello,

    As I was going through a check out, my card got declined. I figured that the limit has been reached, as I couldn't think of any other reason at the time.

    When I returned home and went online to check the statement, I noticed five charges from online vendors. A person who was staying with me until a week ago is the one who made the charges. I know where he is now, I know his full name, birth date, he has a criminal record for a similar offense which he has committed on multiple occasions.

    I want to bring criminal charges this time, however, the total amount is about $200.00. I already made the calls to the credit card company to have the charges reversed.

    How do I proceed if I want the person charged? As of right now, I have: the person's current address, full name and birthday. What other information should I gather? I have never filed a police report but I have the very basic knowledge of criminal procedures. What should be my next step?

    Edit: I have tried contacting the person with no success, he is ignoring my calls and texts. I do, however, know for a fact that it was him. Some of the packages arrived to my house while he was staying with me. He always said they were presents, something he won, etc.

    Go to the police and make a report, providing all of the information you have. If you type it all up in a document, it should save some time when you make your report.

    My main question is, will the cops even bother if it's only 200 that was spent? I figured since the amount is so low, it's best if I get all the info and documents in order. I have never had to deal with the cops in America and where I am originally from, the cops are the last people you call.

    So yeah, if anybody else has any other advice, feel free to share.

    Laws vary by state. What state are you in?

    You cannot generally charge someone yourself. You can make a police report and inform the police you would like to pursue criminal charges and if they can identify a suspect and feel there is probable cause to believe the suspect committed a crime they can request charges through the prosecutor.

    How did he get your credit card info? Has he ever used your card with your permission before?

    The longer you wait, the less likely they will do anything. But, they almost certainly will take a report. Given the amount, depending on the state you are in, it could be petty theft and as such they may not do much more than write a short report and file it. The cost to pursue some of these cases - especially if the suspect is in a different state (or even in a different county) - can be too high to bother with sometimes.

    Since you have already been made whole by the credit card company, the police and the prosecutor may see the credit card company as the victim now and if they don't choose to pursue it, the matter may be closed.

    Thank you. I live in Minnesota, the person has never used my credit card, and I have made it clear that he can't do it. He is now living 10 miles away. It happened 2 days ago. Or that's when I noticed. I have the statement, vendor names, exact amounts, transaction ids.

    So yes, the cops can identify the person, he is nearby, has no means to flee.

    Considering that the evidence is solid, his name and at the time address was on every package that was sent out by the vendor, and all the cops have to do is verify. Do you think they will pursue it? The person has 6 shoplifting convictions, 2 felony drug possession convictions and 2-3 thefts( actual thefts, not shoplifting). I think chances are they will pursue it, but I wanted to get a second opinion on here.

    It sounds as if they have enough to pursue it. Whether they have the resources to do so or not is the question. These cases often involve subpoenas and/or search warrants, and in some places the prosecutor may see the credit card company as the victim now that you have been made whole.

    All you can do is report the crime to the police and touch base with them periodically.
