    Default How to Proceed With a Pro Se Motion to Reduce Child Support

    My question involves child support in the State of: Missouri

    I am a NCP residing in another state. My child lives in St Peters (mother requested to move there some time ago). Long story here but this is my current issue:

    Over the last 6 years I have dropped over 75% of my income, not volentarry. I work in IT sales and have not been able to meet quota and have had to take a low end call center job. I have continued to pay my support while trying to downsize as much as possible. I do have a small daughter that I support full time. Even with downsizing I have to get a modificatiion in support payments. I do not have a dime to spend on a lawyer, I've choose to meet my obligations first. That being said, I did successfully file pro se in MO. I have filed a motion to appear by telephone over a week ago and cannot get any directions from the county clerk on the next steps. The CP was able to afford a lawyer and he filed a motion to dismiss, hearing is this Friday.

    Please help, I just need to know what I need to do next.

    It's Wednesday, you have a hearing on Friday on a motion to dismiss that was filed on grounds unknown to us, and you are trying to appear telephonically but you don't know if the court will approve your request? Sorry to say it, but what you need to do at this point is retain a lawyer.

    The court clerk or county clerk is not going to advise you on the process because they are not lawyers and not allowed to give you legal advice. Although you may not think what you are asking for is legal advice, it likely is.

    If a motion to dismiss was filed in a support modification then there is a good chance your filing was not as successful as you think.

    You should really try to hire an attorney. Otherwise you're likely to find yourself stuck in the same place of paying more child support than you should.
