My question involves labor and employment law for the state of: Ohio

Hello, I was offered a new position at my company back in February of 2014. The new position required me to relocate and I had to sign a relocation contract. The contract states that if I voluntarily terminate my employment within 12 months from the start date of my new position, that I would have to pay back the entire relocation benefits.

I have a new job offer and am waiting to put in my 2 week notice. I intend to put my last day as the 1 year mark from when I started this position. I have been reading that the company can terminate my employment immediately after receiving my resignation letter. I am currently in just a support role helping out where I am needed. I don't have any real position or responsibilities. I could see the company not accepting my 2 weeks and ending my employment immediately when I turn in my resignation letter.

Would I still be liable for paying back the relocation if this happens? I can see both sides here... I am putting in notice that I intend to fulfill my 1 year contract. At the same time, I can see that as soon as I submit a resignation letter that I am voluntarily leaving my position.

A couple side notes: I am no longer in the position I signed on for, for the relocation package. I was removed when there was a change in upper management and have since been placed in a support role. I can't just wait 2 more weeks because the new company has generously given me 6 weeks before my start date. Going back and asking for 2 more weeks would probably be out of the question.

I just don't want to have to pay back an 8k+ relocation package over 2 weeks... I am also a 4.5 year employee and didn't just sign on for 1 year and bolt.
