    Default Failure to Stop for a Stop Sign Ticket at an Intersection with No Signs, VC 22450(A)

    My question involves a traffic ticket from the state of: California

    After i got the ticket a decided to look it up because i didn't understand why i was being cited. Now i am even more confused after reading what it was. I am wondering how i was cited for vc 22450(a) at an intersection with no traffic control signs. I was at a t-intersection and stopped when a vehicle came through then started creeping forward because i couldn't see passed the parked cars on the left then i could see the police car coming so stopped again were he turned into the street i was in then immediately turned around and came in behind me and hit his lights as soon as i took the right turn. He cited me saying it was for passing the limit line. So i am a bit confused on how vc 22450(a) applies to my situation.

    No, the intersection is completely empty not even a crosswalk.

    22450. (a) The driver of any vehicle approaching a stop sign at the
    entrance to, or within, an intersection shall stop at a limit line,
    if marked, otherwise before entering the crosswalk on the near side
    of the intersection.
    If there is no limit line or crosswalk, the driver shall stop at
    the entrance to the intersecting roadway.

    If there is no stop sign or signal, there is no requirement to stop. If there is a sign or signal, and no limit line or crosswalk, the stop must be made at the entrance to the intersecting roadway. This could be an extended curb line (not painted) or the intersecting line defined as the extended pavement edge of the intersecting roadway.

    If there are no stop signs present, take pictures of the intersection or get google images online of the intersection. These should go well with your TR205 Form, Trial by Written Declaration. If the officer doesn't respond or if you are found guilty at this stage, you can go back into court with the officer's written TBD statement, made under oath. When you show this statement to the judge with pictures showing no stop sign is present, you should be acquitted, unless the judge is corrupt.

    You may have been guilty of failure to yield as crossing traffic would have had the right of way and the cop might be trying to say you should have waited for him to pass but it's hard to tell from your description of the event. Be aware that the cop or the judge may try to amend the charge at some point. For right now, the proper thing to do is respond with TBD. I wouldn't mess with discovery as that might inspire the officer to take another look at things and try to amend before arraignment or trial.

    Even by the second time i stopped i know i was not in the intersection but good info why even give him the chance his word would be over mine if it came down to it.

    Donzoh is correct. No stop sign = no stop required under the statute you were cited with violating. However, even if there was a stop sign present, you claim that you did stop, but you creeped forward to see around parked cars. Once you stopped, you fulfilled the requirements of 22450. That you creeped forward is irrelevant.

    Thank you and one more thing not sure if it has any relevance to anything it is more out of curiosity i noticed under commercial the ticket is marked yes. Is that right?

    Unless you were driving a commercial vehicle (i.e., a truck or bus other than certain exempted things like RV's and horse transporters) it's immaterial. However, that error is entirely inconsequential to your defense.
