    Default Evading and Eluding in Florida

    Ok, I was caught for evading and eluding a police officer, culpable negligence , and DWLS on my MOTORCYCLE... the FHP came up behind me at the end of one county (didn’t turn on his lights for the first 5 minutes ) , he came very close to my BIKE, Dangerously close so he can take down my tag of my small license plate... anyway he spooked the shit out of me and I took him, not knowing he was a cop, anyway.... anyway, I had a passenger with me who was terrified and asked me to stop, but me being a nervous wreck at the time continued ... until I saw a 2nd police officer and I slowed down 4 him, by then we were in Broward county(it started in Dade county , fl) ... the 2nd cop didn’t come to help at all... and the first one finally comes up from behind besides me.... I realize he was a cop, pulled over on my bike... the passenger frightened, gave a statement against me and hasn’t talked to me since... the police officer... , who was a state officer stationed in Broward, wrote the whole police report as if it all happened in Broward, he falsified the whole thing ... can I use that to get out of this mess I am in???What are the rules when it comes to this kind of thing??? if I can prove that the whole police report is false... will it help me or hurt me even more because I would face prosecution in both counties? Instead of just 1? Also, I believe there are anti-chase laws in Florida … didn’t this police officer violate those laws??? He stated himself that he almost rear ended me on my motorcycle when I finally stopped…
    Can I use the fact that I was nervous, and that I wasn’t thinking straight to get out of this?
    I got a lawyer representing me , but I don’t like the work he’s doing . He got me a plea bargain of 6 month house arrest , followed by two years probation … and judication… I don’t mind being punished for what has happened but the judication will ruin the rest of my life … I am trying to get a property appraisal and real estate license in Florida. Does anyone know what this kind of felony judication can harm me as far as trying to get those licenses?


    i got until thursday morning to take thier plea offer... or i have to go to trial... this plea offer is from the judge... the state wanted 30 days jail plus two years probation and judication...

    what about the chase laws in florida? i thought police officers werent allowed to chase people anymore?

    I did not find any new law that states the police can not chase vehicles. Each department has policies on chasing, but that doesn't make it a law.
