    Default Written Up for Missing a Shift, but Was Not Informed of Schedule Change

    My question involves labor and employment law for the state of: OK (non-union) not federal. I work shift work and our schedule is posted bi-monthly. I was aware of our two week schedule and was not working any above my currently assigned shift. While I am on off days, an employee changes the scheduled which reflects me working one day of my off days. I was not informed by phone, sms, email, fax or carrier pigeon. So I was not made aware of this change. I get a phone call the day of said schedule change. Supervisor asking why I am not at work! I explain I was not aware I was on schedule. Supervisor spoke to person taking day off and he/she said we spoke face to face about the change. This face to face statement is an absolute fabrication and I was not aware of change. When I return on my next scheduled shift; Supervisor states I'm lying and wants me to sign a disciplinary action form. I showed him\her the timestamp on SharePoint of when the last edit to our schedule was made indicating the schedule was changed while I was on off time, then the schedule I saw was removed and replaced on the corkboard and the edited schedule was then posted. Supervisor insist I sign this disciplinary form because I am lying. I didn't sign and after 2 hours of his/her interrogation style conference ending with me not signing the form and supervisors derogatory statement that I lied.

    Okay, if you don't want to sign, don't sign. If they terminate you for not signing, then file for unemployment insurance and try to convince them of your situation. If they don't, in other words, if they have you sign the disciplinary form, and you refuse, and they don't fire you, then don't have any more problems, and you're still home free. As far as who you could appeal to, in a non union situation like your employer, to keep you from being disciplined, there's nobody. They can basically do anything they want to to you and you have no recourse except to quit (which means NO unemployment while you're not working) or keep working and see if they decide to fire you, and if they do, then you have a pretty good chance of being approved, if they cannot show a good work related misconduct reason to terminate you.

    It is your decision to stand on principal and deal with the outcome. Let your conscience, your finances, your family and your ability to become reemployed as your guide.

    Thanks everyone for your assistance. The issue is resolved.

    Supervisor shredded the disciplinary form after realizing I wasn't lying. I mean honestly, what would I have to gain by not reporting to work. I know HR is there for the company and employees are irrelevant; nonetheless, employees "should" be treated equally but most are not due to family involvement or favoritism. Anyways, he/she apologized to me and problem is gone.
