    Default Qualifying For an EB2 or EB3 Visa

    Hello Everyone,

    My job position is Agile QA Lead. My Job requirement is Masters in Computer Science or equivalent + minimum 3 years of experience.
    I have an MBA + 3.5 years of experience. My company's lawyer are saying that my GC cannot be filed in EB2 category because i don't have masters in computer science. Is there any argument on the basis of which i can tell them to file my GC in eb2 or i will have to file the GC in eb3 only?

    There's no argument that can FORCE them to do things they don't want to do. They're under no obligation to taken on aliens not already authorized to work in the US.

    And yes, the EB2 needs a job that requires an ADVANCED DEGREE in the FIELD. Your MBA is worthless for technical positions.

    thank you for your reply. Requirement says Masters in Computer Science or equivalent. Can i try to get an education evaluation for my MBA to see if the degree i have is equivalent to MS or not.

    Please don't think I am trying to make this personnel it is not meant to be. The overwhelming attempt of companies in the US to cut wages has led to a thriving industry where companies offer a fraction of market rate for employees in hopes of filling the position with people on visas that will work for substandard wages to get into the US. The result of this is they have also become very experience specific in their recruitment because it allows them to recruit globally rather than from a pool in just the US. You are as unqualified for this position as thousands of US citizens, who have been unemployed and would take it based on close qualifications just to feed their families. That does not mean you are unqualified to get the right job you qualify for, however, you do not meet the visa requirement to notch out US citizens. No argument will change that. Your MBA is no where close to a Computer Science degree. Now that you have the bad news, if you take a few more courses, you might be able to become and Accountant specializing in international corporations. Statistically, there has been a significant decline in the number of people seeking seeking MBA's in the US because it is a degree that basically means you have had exposure to many different aspects of business, but not enough to do anything proficiently in one specifically. The accounting joke is those not good enough to become an accountant get an MBA and pray they eventually will becomes a company president where it will look good on their letterhead.

    Your MBA is NO way comparable to a degree is CS. You do not mention what your bachelors is in. If in business and not CS, you have problems as well.

    Accept what is offered or find a job for which you are qualified.
