    This is why we have many outstanding professionals in various fields identifying material hazards and outlining them on things such as material safety data sheets. Does that live up to an acceptable standard for considering something unambiguously a respiratory irritant?

    That is why we have MSDS sheet employers are required to keep available and are taught proper handling methods.

    Keep the specifics between you and the doctor, while your employer looks at the reality I pointed out if you wish. Your employer is also likely wondering why you went back into the space when it was foreseeable the welders/cutters were at lunch and coming back, yet you did not take steps to insure a safe work space.

    I'm not sure what I was expecting to hear as advice on this site. But if the above arguments represent the general quality of logic I can expect to be going up against, at least it has improved my confidence.

    Okay, I'll play along. It is totally their fault. You are having respiratory problems solely because of their negligence. You should sue them for 50 billion dollars and then be a nice guy and settle for 10 billion, which they will immediately write you a check for.

    I'm not talking about lawsuits. My immediate concern is protecting my health, and my job. My employer is making me choose between the two. I want to know if there is any recourse (preferably with immediate effect) I have to prevent disciplinary action, or the loss of my job for refusing to violate my doctors work restrictions.

    I never said they were required by law to make up a position for me. I said that human resources told me they would accommodate me. They then put that in the hands of the supervisors to make the accommodation. The supervisors are refusing, and HR is not of any help in dealing with the supervisors. HR just repeats that it is their policy to accommodate me, and that if I don't come in to work and perform within my restrictions I will lose my workers comp coverage and my job. My supervisors just keep refusing to make the accommodation.

    They can't accommodate you if there is no work within your restrictions.
