    Default Termination for Sexual Harassment

    My question involves unemployment benefits for the state of: washington

    Hello

    I have a question about unemployment

    1st incident i had was when i made a derogatory comment about some 50 year old womens 20 something year old kids

    That was a warning

    2nd was when this girl started working at my job and started to be carefree with me meaning smiling joking around whatever. Well i kind of took it upon myself to get more personal and talk about her facebook and such and downloaded her pics and kinda show her, but yet after that she tried to make some advances on me still.

    3rd reason i didnt know about was a bunch of hearsay and not much was said and also that i took pics of a girl at work in the break room.

    So my human resource manager took all those things into consideration and decided to let me go

    Well in my employee handbook the last 2 things were not sexual harassment or harassment at all.

    The 2 jpgs contain my employee handbook contain the definition of sexual harrassment and harrassment.

    As you can see to be disqualified for has to be a good cause for misconduct.
    In all honesty i dont think i committed an act of misconduct the 1st incident yes i have to admit that but the 2nd and 3rd incidents no.
    If you look at my employee handbook it states what sexual harrassment or harrassment is you see the girl whos facebooked i showed was perfectly fine with it i even asked her permission if i can show her how i noticed her.
    There was nothing sexual of that nature or did i harass her about it. Idk if any of you have facebook but when you log on you the "who you may know feature"

    That is all i showed her nothing else. Now the 3rd incidents was just allegations which was based upon hearsay, you see they were false because i did not take any pictures of the girl and she just lied about it.

    You see you cant build your evidence upon hearsay. Without any proof how do you know if the person is telling the truth? Unless you have witnesses. Which the girl did not provide any.

    What are you trying to prove? (That's a real question - I can't tell.)

    That you're entitled to unemployment?
    That you shouldn't be/have been fired?
    That you cannot be charged with sexual harassment?
    All of the above?
    None of the above?

    That im entitled to unemployment. Basically this is my 2nd go around with it.
    I won my 1st case 2 years ago because i did not get fired for misconduct. Also the fact i had to be my own lawyer, but that is a different story. I got fired for misconduct.

    And what are you looking for us to do? Our opinion doesn't count - only that of the UI commission.

    As you can see when i filed for my unemployment i gave them a detailed description of the accounts that happened
    I also made a copy of my employee handbook and faxed it along with what i showed the female coworker

    I understand that but i need your thoughts if this is considered misconduct or not.
