My question involves criminal law for the state of: Arkansas
My friends (ages 17, 16, and 15) were recently arrested for trespassing, possession of marijuana, and possession of marijuana paraphernalia. All three have never been in trouble with the law before. Here's how everything went: over the holidays, their friend and his family were out of the country and the friend told my three friends that they could come stay in his house while his family was gone. The friend did not, however, get permission from or tell his parents that his friends would be there. The neighbors of the guy's house where my three friends were staying saw a car in the driveway and, knowing the family was out of the country, called the police. The police then came and arrested my three friends for trespassing and also found weed and bongs in their possession. All of their families were notified and the three guys spent a night in the juvenile center and will have a court date in a few months for the weed charges, but the homeowners of the house they were in were not going to press charges for the trespassing. However, that was before they discovered $200 missing from their home. My friends have since paid the $200 back to the homeowners, but they do not know yet if they are going to press charges for the trespassing/burglary. Assuming they do not press charges, we are under the impression that they will likely just get a year of probation for the weed charges and then it will be wiped from their record when they turn 18? What would the consequences be IF the homeowners do press charges though?
