Default Reminding Ex- About Homemade Porn in My Possession

My question involves criminal law for the state of: VA

I think I made a very dumb move. My ex contacted me several times since breakup. We even agreed to do joint counseling on neutral grounds. When she was a no-show, I was trying to text her a few times to check what happened along with several other questions and got no reply. So I thought I send her an e-mail asking if she remembered when we made porn of her that "one special night" just to make her talk or say something. Next thing I know, her current boyfriend called me to lecture me that I shouldn't be sending those kind of e-mails because she could call the cops on me or sue me on blackmail charges. Can that really happen even if I never had any other intentions besides just to try make her text/e-mail me back? I don't even have any intention at all of leaking it out on Internet since I'm well aware of revenge porn laws.

    "Dumb" doesn't quite cover it.

Yes, theoretically she can make your life hellish at least for awhile

So drop it. Go forth and harass no more.

Even if I have ceased all contact since then, can she still sick the cops or a lawyer on me using that e-mail against me even months or years later? Does it make a difference too if we live in different states? What's the worst case scenario for me?

Might I also suggest, as a conciliatory gesture, that you destroy said reminder?

As time goes by it becomes less and less of an issue.... and that's if she does anything. There's no guarantee that you'd face the wrong side of the law, but it's a good step to simply remove her from your world...and by that I mean lose her number. Permanently.

The answer to all of your "can" questions is yes, any or all of that "can" happen. Will it? Can't predict because my crystal ball broke.

For criminal charges misdemeanors can be brought from 1 to 3 years, felonies a lot longer.

Tort (civil wrong) actions often have a 1 or 2 year statute of limitations.

I doubt if anything will come of it but you wanted worst case scenario.
