My question involves child support in the State of: Georgia

After 2 years of trying to enforce an out of state Child Support Order, the date has finally come for court. My ex has an arrears balance of over $15,000 as he has not paid a dime in 2 1/2 years, and never bothered to file for modification after losing his job several times and being unemployed for the last 2 years. He is unable to gain employment because he is not legal to work in the U.S. The case was originally out of Colorado, but we now both live in GA. All calculations are based on the original order.


I plan to ask that the arrears balance be forgiven so long as my ex begins making regular payments immediately through Family Support Registry. I would also agree to a reduced monthly amount, probably $150-$200 per month, as I do not need as much as was originally ordered ($492.00 per month) I am married and have 2 incomes, he is newly separated and barely making ends meet, so I know that he wouldn't be able to make big payments anyway, and it seems futile to even expect him to pay that much. I would much rather have the support decreased than have to explain to my daughter why her Dad is in jail....

What should I expect in court? This is our first court date since the divorce. How should I address this with the judge? Will they even ask my opinion? Will they impute his wages even though he is an illegal? I know no one has a crystal ball to predict the future, just looking for some guidance from some that are more experienced. We have Judge Joann Bowens in Fulton County if that helps.
