My question involves labor and employment law for the state of: New York
Hi,
I was recently let go. I had 5 weeks of vacation unused. My employment contract specifically states that I cannot encash unused vacation.
(1) Being overly optimistic on this question 1, Is there a chance that I can lay claim to encashing the unused vacation, somehow overriding the clause in the Employment contract.
(2) My manager mentioned in the initial days itself that our group is generally speaking not expected to take vacation, since we have high pressure jobs or what not. He repeatedly declined requests for vacation or at best reduced the number of days he granted leave for.
I could not even take a total vacation of a week for the year. Taking a minimum of 10 days vacation is mandatory as per employment manual.
I have emails for proof of vacation denial/reduction. Given that, Is there any way I can lay claim to the unused vacation?
Thanks
