    Default Running a Lottery in California

    My question involves business law in the state of: California

    This is purely hypothetical, but I was reading California law on lotteries. It appears that a lottery can only be held commercially if there is a free way to enter as an alternative to paid entry. In addition, the lottery can't discriminate between paid and unpaid entries. Can a lottery allow someone to enter once for free, and then offer to enter additional times for a paid amount?

    You can't do that without violating PC Sec. 319.
    Quote Quoting California Penal Code, Sec. 319
    A lottery is any scheme for the disposal or distribution of property by chance, among persons who have paid or promised to pay any valuable consideration for the chance of obtaining such property or a portion of it, or for any share or any interest in such property, upon any agreement, understanding, or expectation that it is to be distributed or disposed of by lot or chance, whether called a lottery, raffle, or gift enterprise, or by whatever name the same may be known.
