    Default Parking lot accident, other driver at fault

    In Michigan at a walgreen parking lot. My daughter was driving in front of the store when a man pulled out from a side isle and hit her drivers door causing just enought damage to file a claim with AAA. She attemped to call the police and they stated in a parking lot they would not come and file report. She is 16 years old and was a not aware of the type of info to obtain from this man. However he did give her his name, address and phone number but withheld his insurance info. Well our deductable was $400 which I understand under the mini-tort law, he or his insurance co. are resposible for my reinbursment. Well on any time I have contacted him for his insurance information he now has stated that he may not admit fault after all. Clearly by where the damage is on our car, it could only have been caused by what my daughter said had happened. At the time he apparently did admit to her that he was indeed sorrry and was to blame. But now obviously it will be word against word. What kind of documentation do I need to make him or his insurance company pay for my deductable. The car is repaired, so I have the damage report from the collision company but that is all the documention I have at this time. Please help me decide my next step in retrieving this money.     Are you in touch with his insurance company yet?

    Not yet. Did not know if I should have my insurance adjuster do it or not.

    Personally, if I were making a claim anyway and the adjuster were willing, I would have the adjuster handle it.

    I personally have "broad form" coverage, so it's not even an issue for me - if I'm not at fault the insurance company doesn't charge the deductible, but attempts to subrogate from the at-fault driver's insurance.

    Well my adjuster says the State of Michigan does not allow them to step in for the purpose of my deductable. I went today to the insurance agent of the at-fault driver. They basically told me that their client is not willing to allow them to reimburse me for my $400. So my next move will be small claims court. But I have no police report. It is now my 16 year old daughters word against his. She was alone in the car, however his wife was with him as his witness. Iam no expert but based on the damage to both cars, I can clearly see that he for certain must have hit her. But will that be enough to win in a court of law? I also have a letter from him stating he was willing to write me a check for $200.
