My question involves paternity law for the State of: Connecticut
My brother and his wife are in the process of getting divorced. She has recently given birth to a child, and although her legal last name and my brothers last name are the same and was at the time of birth, she has without my brother's permission or knowledge, given the child her maiden name. He only recently found out about the different last name when my brother applied for a copy of his child's birth certificate. My brother was told at the hospital by staff and his soon to be ex-wife that he did not need to sign the child's birth certificate because both parents were still married, and paternity was not an issue. The mother had even said the child would have his last name during negotiations for divorce. My brother did not give permission for his child to have a different last name. What are his rights?
