    Default All units raided in Chicago walk up

    Yesterday evening my husband and I returned from a weekend out of town to find our third floor walk up door crashed in and our apartment turned upside down. We called the police thinking that we had been robbed, but after they arrived learned that the house had been raided earlier that day. The warrant (which we never saw) was for drugs and guns for the occupants in the apartment below ours. Is this legal? Not only did the police strew my undergarments all over the apartment, they left our door hanging on the hinges and all the lights on. Anyone could have entered our home and taken anything they wanted. We were also told that had our dog been in the house and not with us he probably would have been killed (even though he is in no way an attack dog). We do not know our neighbors nor would the police have any reason to suspect us of any wrong doing. We are not being charged with anything (because we didn't DO anything) but they destroyed our doors and several pieces of luggage. Do we have any recourse??

    I'd suggest you contact a civil rights attorney. With the property damage resulting from the allegedly unlawful entry and search you may have a claim under 42 USC 1983 or some similar type of state law but more facts would need to be gathered--evidently some type of search was authorized by a judge and it would be important to pin down how it was that the police ended up in your apartment.

    you should go after these idiot's with all you've got. police think they can get away with murder....and sometime's they do.

    You state that "all units" were raided - were there more than the two units?

    There are three units in the house; a garden level, main floor, and we are on the top floor. All have separate entrances. The police have now stated that they could enter our level because the door was unlocked (I assure you it was not; we were out of town for the weekend). If this was true why is my front door kicked in?

    The police often like to enter from all points of entry, when there is more than one. If they claim one door was unlocked, but they entered through two doors, they would have to kick down the second door. (I'm not trying to justify their actions, but that's a possible explanation.)
