    Default Under Investigation for Stealing from Work Due to Similar Pawned Items

    My question involves criminal law for the state of: Texas

    I pawned a some diamond earrings last year and a my necklace. I work in Gordons Jewelers and this year we noticed things missing, the detective said sinced i pawned items that fit the description he thinks i took it, he said if i can provide proof its mine he would drop charges. But my thing is, if i pawned it last year why would he need proof on those items when the report was made this year like two months ago? Do i need to give him proof? I have proof i would have to really search for it because i had them for a while but why do he need the proof? He said the description fits but he dont have any pictures of the items, he's just assuming it was from there.

    You seem to have a lot of issues with pawning items. If you can find the proof and provide it, then it may get the detective off your back. If things are missing back to last year and similar items are included, it does kinda make you look bad.

    You can choose not to provide the proof and then provide it if/when you go to court. Either way, I'd spend a little bit of my free time tracking down that proof.

    I do pawn things, my family passes down jewelry a lot but i feel like if things went missing this year why do i need proof of stuff i pawned last year? The things he have in his possession right now i dont have a problem providing receipts for. and i caught the detective in a lie he said $100,000 worth or merchandise been missing since was last but when the invetory lady came last year 2013 and did a complete check we only had like $500 worth or things missing. Stuff didnt go missing until this year towards summer time, and we had a lot of people coming in to work from different stores because we was short. And he said even if the camara dont see anything i still wont be in the clear and he also said he dont have proof like pictures of the items missing that i pawned they just fit the description and he's going off of that

    Now you're inheriting things rather than buying them off craigs list. If you're going to keep changing your story, you need to do it in a forum without a history.

    Frankly, the cops and the LP already think yoiu're guilty and you're not going to talk you way out of it with lame excuses. I'd not talk to them further, they're only looking for you to incriminate yourself.

    Write back if you actually get charged with something.

    They're free to fire you if they haven't already. You obviously have a conflict of interest even if you're not the one stealing the inventory.

    The detective is not there to help you.

    He's there to arrest you and put you in jail.

    Stop talking to him and get yourself an attorney.

    Bottom line is you are going to need that proof, now or in court. Which is your choice. The detective likes you for it and is going full steam ahead.

    P.S. The police are allowed to lie to you.

    I'd be combing through the yellow pages for a Criminal Defense Lawyer. You will want one on hand.

    I'd be watching your a$$ at work and be on your best behavior.

    If I got something from a friend/relative/inheritance, or bought something and pawned...I'd be making darned sure I found the receipts for purchases/pawns, or got written statements "To whom it may concern, I certify under penalty of law that I gave Ashye a (full description of item) on (date). Sworn in front of a Notary Public by (givers name - this does not get signed until in front of a Notorary, there will be her signature and her stamp on it, and they will not sign/stamp unless you are right there).

    Important: Please note. While you may feel free to ask a friend to write a statement and have it notorized, your friend will have to go to the Notory with you. And if your friend lies, your friend faces criminal charges and a criminal record......
