    Default Hospital is Suing Over an Unpaid Balance and Won't Accept Payments

    My question involves collection proceedings in the State of: Ohio. Long story short I had a surgery in July of 2013. My medical bills turned out right around $14000. I have been paying $150.00 a month, what I can afford because I'm a full time student and mother. I called into the attourney that's handling the case and asked him "what is the monthly payment that they are willing to accept?" Thinking maybe I can squander another $50.00 out of our budget and he said " They'll not accept the $150.00 a month because it will take 96 months and they're not willing to wait that long, the payment is more than likely going to be much more expensive or they'll accept an 80% settlement." Problem is I'm paying what I can afford and I don't have $11,000 just sitting around the house. What can I do and why are they trying to ruin my life?

    They're not trying to ruin your life. They're trying to get paid.

    Thanks for the post but this is not helpful. I'm paying what I can afford. $150.00 a month is getting paid.

    I'm not sure what you expect here.

    They're owed money, and they have the right to use any available means necessary - even if you're paying every month.

    Is the payment plan actually one that the hospital has agreed to, or are you just paying that amount every month?

    It was verbally agreed upon. They take the payment directly out of my checking account. I did not sign a document saying we agreed to this but I did sign a document allowing them to withdrawal that amount out of my account. Im sorry that I didn't include this question but I was wondering, was there a way to avoid ruining my credit? I Understand I have a debt I'm obligated to pay and I intend to pay it. Is there any other route I can take to avoid collections and bankruptcy?

    That's between you and the hospital billing department. There is no law you can invoke that will force them to continue to accept payments in the same way/amount you have been making them.

    Usually as long as payments are being made they'll hold off the court action, but there's really not an awful lot you can do if they're not willing to work with you. Bankruptcy is a valid consideration.

    Does whatever you signed contain any sort of promise on their part?

    I've read it and don't see it. It just seems unprofessional to accept the $150.00 payments and w/o contacting us, sue us a year later. If it is reasonable, I'm willing to do what I can to take care of the obligated debt. What does bankruptcy do? I know it'll hurt my credit and that'll affect my career. I'm going to contact a lender. Maybe I can get cheap payment plan through them. If not I guess I've got no choice but to ruin all I've worked hard for.

    not always true. If she can show they agreed to accept the payments, at that particular amount by agreement, the hospital cannot just terminate the agreement.

    I wonder why the change of heart though. If she was making payments for a year and is just now being sued, I suspect there is more to the story.
