    Default How to Report Possible Bankruptcy Fraud

    My question involves bankruptcy in the state of: Florida

    Hi all,

    I have a question regarding suspected bankruptcy fraud and wanted to hear what other people think. I did work for a guy about a month or so ago and went I went to collect my check it was in someone else's name. I thought it was kind of strange. He stated it was his aunt and she was the real owner of the property and he was just taking care of it. Anyway, I found it odd so I did a little research and here is what I have found out through public records.

    He filed for Chapter 7 bankruptcy in March this year for about 450,000. It was then discharged but then reopened by himself because he forgot to add a personal injury lawsuit which may be declared as income. So currently the case is open.

    I have found out by talking to him that his Aunt, who currently lives with him, has purchased vacant land for 150,000. He is planning on building a 3-4,000 square foot house on it. I would assume this would cost minimum 400,000? He has been doing all the planning of this, hiring contractors, talking to builders, getting surveys, permits etc. The only thing I know about the Aunt is that she is 84 years old and just recently sold her house of 28 years for 108,000 which she still had a mortgage on. So, it doesn't sound like she is really well off either.

    His reported income over the past 3 years has been 5,000 a year.

    This just doesn't sit right with me. I believe that at best something sketchy is going on here and at worst some sort of bankruptcy fraud. I have contacted the trustee but when I wish to remain anonymous she will not even talk to me. She basically says if you have info about a debtor I need to know who you are and what you know otherwise I do not want to have this conversation. I have no interest in revealing my identity. I have nothing to gain from reporting this. I just hate to see people gaming the system while I'm out there working hard and paying taxes. Anyway, I would love to hear any advice. Thanks.

    What it to you? Does he owe you any money? If not you really have no real status to make a complaint. If you feel he's illegally hiding assets or whatever, you can certainly point this out to the trustee when one is appointed. The trustee represents the creditors not the bankrupt person/business.

    Leave it alone.

    1. You have no personal, first hand, knowledge of the debtor’s business or financial dealings.

    2. The information you are accessing appears to be of public record or maybe hearsay from some 3rd party. The public record is the same public record that the Chapter 7 Trustee and the US Trustee can and will look at in many instances.

    3. You are coming to conclusions based upon public records (and/or hearsay) without access to anything that backs up your assumptions.

    4. For all you know that home the debtor is “building” is being financed by another family member, business partner or good friend. Further, the activity is post petition therefore, has nothing to do with the current Chapter 7 unless the debtor is utilizing non-exempt assets he had at the time he filed bk.

    You simply have no direct evidence of anything. Supposition and innuendo is not evidence. This is the reason the US Trustee wants nothing to do with you, especially if you are unwilling to give your name.
