    Default Can You Get Your Supervisor Switched Over Response to Medical Issues

    I am based in New Jersey and I work for a pharmaceutical company. I have been with this company for over three years now.
    I have been hospitalized twice this year; i.e. in April and June of this year respectively for severe chest pain. Despite of my health condition, my current manger requested that I continue to work immediately after my discharge from the hospital while I was on sick leave. I took this matter to my HR and was advised to reach out to the Reed Group and they immediately put me into FMLA and was later transition into short-term medical leave for four months.

    I am 45 years old and for the record, this is the first time that I have ever been on medical leave of any type. Working under my current manager has significantly contributed stress that I have been experiencing in my position due to the demanding nature of her treatment.
    My psychiatrist wrote a medical letter to my HR and advised that the situation be improved. I have personally reached out to HR with a request to change my supervisor but it has been turned off a deaf ear with an excuse that the current management team would like to work out this matter.

    I joined back in Oct with the hope that the management would take my health seriously but the situation is turning out worse than ever as it isn't improving. My manager is assigning me into roles that I am not a subject matter expert without any resource and with unrealistic timeline. She is highly critical of my work and that is contributing so much of stress in my life that the symptoms are coming back. I have recently been having severe headaches and have been advised by the neuroscience to have a MRI done of my brain. My workload has significantly increased that I have no time to get my scanning done.

    I need to know what options I have and what should I do. Perhaps I really need a good attorney. Any advice?

    There is no law you can invoke that will force the employer or HR to switch you to another supervisor.
