I am currently living with my boyfriend who has been offered a job in MN. The job is not 100% secure yet but wanted to get ducks in a row so if it is going to happen I can move out there with him and take my two children.
I am the primary custodial parent and have joint legal custody of the children with my ex. From what I read in my custody agreement there is nothing stated that prohibits me from leaving the state and from what I read on line I have to petition the state to move out of state with the children. Am I correct on this having to petition the court for the move?
I will not move out of state till my son is out of school for the year. That would mean 6 months of planning to make the move smoother and between flying out on weekends my ex has the children I can gain the information on the schools in the area, childcare for after school, and employment if the ex takes his time with the children and doesnt fight the move right after school is out I can take those days and gain employment.
I have been rather easy on the custody agreement allowing additional time with the children over the summer and not going hard ball on him if he couldnt keep a weekend due to any factors that came up.
I would be pay the childrens way to see their father over the summer (if flying OR drive them the entire way in) and give him 1/2 of their summers or more if he would like more. And every other Christmas or Easter break during the school year.
That being said could anyone find any cause that could make this a no go in court if the ex doesnt constest the move?
