    Default Changing an Infant's Last Name to the Mother's

    My question involves name change laws in the State of: North Carolina regarding changing the last name of my 5 mo. old child's from her father's to mine. When I was 5 months pregnant the father of my child went through a mental change and was in and out of behavioral health institutions and then ultimately was incarcerated. Since she has been born he has not made any contact to see her and has made it obvious he has no intention to be apart of her life. What can I do to change her name to mine since I am her only parent? Also can I get her name changed without his consent even if his name is on the birth certificate?

    You can petition for the name change and, if the father opposes it, attempt to convince the court that the name change is in the child's best interest.
