    Default Falsely Accused of Shoplifting from a Store

    I am from Wisconsin. Yesterday I was in ShopKo (which is like a Wal-Mart, Target, K-Mart) with two of my friends. One friend and I were looking at shoes while the other was looking at underware. She came over by us and told us what she found, and the my other friend was interested and we went over and looked. I was holding my mittens in my hands (which are big, white and furry). I didn't want to hold them so I put them in my purse. I picked up a pair and put them back down. I stood there for a while why my two friends continuted looking at the underware. A few minutes later we went to go check out. I didn't purchase anything but my two friends did, so I went and waited by the doors.

    After they checked out, we walked through the frist set of doors and then the second. We were walking to my car and a guy from LP and a ShopKo employee approached me and said "Mam, ShopKo security, would you please come with me?" I was in utter shock! I said, "Excuse me, what did I do?" He just said, "Come into my office." Having been employed at this ShopKo store I knew the proceedure and knew that they were going to accuse me of shoplifting.

    I went and sat down in his office, because I was already very embarrased and didn't want to cause a big scene. He asked me what I stuck in my purse when I was in the underware section, and I pulled my mittens out and said nothing...I just had my mittens in my hands and didn't want to hold onto them anymore so I put them in my purse. He asked me if I put anything else in my purse and I said no, I did not. I asked him if he wanted me to empty out my purse so he could see that I didn't take anything from the store. He sat there and said, boy I feel like an ass.

    I told him that I wasn't that dumb to do anything like that especially since I had previously worked there. He asked me when I was employed there and I told him that I had quit back in April. He said oh, sorry, you can leave.

    I called one of my friends who also used to work there and told her the story of what had happened and later that night I called my parents as well to tell them the story.

    My mom had told the story to her boss who said that I could and should try to take legal action. My friend who I talked to said the same thing.
    My only concern is whether or not I can, and if so what course of legal action could be taken.

    First of all, what is the dollar amount of the actual and direct damages you suffered?

    It sounds like he made an understandable, honest mistake that caused little commotion and no true embarrassment. I'd suggest you forget about it.

    This Loss Prevention Officer was either poorly trained or just plain not cut out for LP work. He clearly didnot have the requirements to make a shoplifting stop. that being said you "could" sue which means hiring a Lawyer then waiting a year or more for results. Win or lose you still must pay Lawyer unless you have win or pay nothing Attorney! You can do one of two things forget as suggested or contact Store Manager who will likely give you a gift card for store for your trouble

    I think finding a lawyer who would take the case on contingency would be extremely difficult....because I don't think he'd ever be able to convince a jury that you were harmed. Hurt feelings and a few minutes of inconvenience rarely make people eligible for compensation.
