My question involves estate proceedings in the state of: FLorida
I posted a question a few days ago regarding sealed assets in my ex's will. Thank you for your responses. I have another question I hope someone can answer.
Our custody agreement and parenting plan which was signed last year in court required my ex and myself to take out life insurance policies until our daughter turned 18 in the event one of us died unexpectedly. To date, his family cannot locate any policies or any premium payments so it looks as if he did not comply with the agreement. My ex was a physician and paid a significant amount of child support to me, which is now lost. I have an appointment with social security to apply for survivors benefits for our daughter, but the process is slow. My ex's will states that our daughter will not get her portion of his estate until she turns 30.
Can I recover the amount of life insurance he was supposed to have from the estate? I do plan on applying for family allowance, but I would hit the maximum $18,000 in just a year.
