    Default Admitting Business Reports as Evidence in a Trial

    My question involves criminal law for the state of: Tennessee - Can prosecution use a business report as evidence in a theft of property from another county and even another state, without the author of the said report as a witness in court? Thank you for your help.

    Depends on what's in the business report and how the prosecutor intends to use it and how the foundation is laid and probably a lot of other factors that might be at issue.

    Also depends on whether or not anybody objects to it and why.

    It was objected to in the preliminary hearing in general sessions court and the judge stated that he did not know if it would be admissable in criminal court without the author of the report, but he did look at it do to the fact that it was a general sessions court preliminary hearing and only probable cause had to be proven. The judge also stated that the DA was trying to get a felony conviction and that he would most likely if anything only be able to get a misdemeanor. Thanks for your comments.

    Here's the problem.

    You've posted several brief questions that appear hypothetical and have no context. That's just annoying, wastes time, and discourages responses.
