    Default Suspension of a Teacher for Misconduct

    My question involves education law in the State of: Arizona

    Please forgive me if I used terms incorrectly:

    My brother was placed on administrative leave from his district yesterday for what they called reporting issues with IEP's in special education. He said also received a letter from the district regarding unprofessional conduct and violation of policies of the governing board. He has been with this district for 18 years and said he is excellent standing. According to him, they would not say more and he could not get anything specific, but that it was an internal investigation within the district and they were looking at things from a legal perspective. They informed him they would contact him when they had additional information. I talked with him about any potential issues they may find, keep in mind I don't understand what he said, but did write down what he told me. He said in some of the IEP's he has written, he has not verified some of the information. When I asked him to elaborate, he said the IEP's may have inaccurate information in some of the areas such as the (PLEP?) and assessment sections. He also told me he does a lot of cutting and pasting to save time, but changes the students names and information. He said nothing could happen if they find nothing, he could get a reprimand or get fired. He is really fearful he is going to get fired, does he have reason to be worried?

    He has very good reason to be concerned. It sounds like he is not acting professionally. If he's represented by the teachers association (union) he had best be seeing if they can provide him representation. Shamming the iEP process is very bad for special ed teachers (as he should know). Cookie cuttering the plan itself isn't so bad as it's supposed to be reviewed by the him, other school staff, and the parents. Shamming the documentation however can get him into big trouble, not just from the school system but from the parents/guardians of the child.

    Regarding the law, your brother has no legal recourse. There are no laws out there governing employee suspensions, and terminations are considered at-will absent a contract stating otherwise. Your brother's only recourse is through his union.
