    Question How to Draft a Petition for Legal Separation

    My question involves a marriage in the state of: Washington

    How should the 1.8 Property be worded? I want to protect both partys from any future disagreement concerning the matter.

    In summery:

    We have no children, no debt, and are fully agreeing on every aspect of the separation. We have split banking accounts and agreed upon investment account and 401k. She moved out almost a month go and we agreed upon all items that she took with her. I was present and assisted with the moving. There are a few items that we want to agree upon at a later time, like a washer and dryer that we both don't need right now, but are new and might want at a later date.

    Will the following work? Any suggestions?




    [X] The petitioner should be awarded the parties’ interest in the following property:

    The Full Balance of personal checking and savings account setup on 11/2/2014
    The remaining balance of Investment account and 401k excluding the awarding to respondent listed below.
    2010 Mitsubishi Outlander

    [X] The respondent should be awarded the parties’ interest in the following property:

    Full balance of Checking and Savings accounts as of 11/10/2014: $4,368.01
    Half of the Investment Accrual while married as of 11/10/2014: $4,423.14
    Arbitrary agreed upon fixed value of petitioner's 401k: $5,000
    Full Balance of Respondent's 401k
    2002 Grand Prix

    All assets that have already been agreed upon can no longer be contested.
    All remaining assets that cannot not been decided upon will be sold and value split half to petitioner and respondent

    We know nothing about your estate, and thus are not in a position to suggest how you might draft language to distribute the assets, whether your proposal is fair, or whether it is acceptable to your spouse. If you need that type of help, you should retain a lawyer. Generally speaking, you would want to identify accounts in a more specific manner, but without putting private information into the record; in some states the approach is to identify accounts by virtue of the last four digits of the account number (the IRA with an account number ending with '2345'").
