    Question 30 Day Notice. Landlord charging past rent

    Hello,
    I was on a year lease and my rent went up so I let my lease expire and my next months rent would now be month to month. I found a new place with a couple of weeks to spare, gave notice and was told that I would be charged with the following months rent. Landlords said that I would lose my deposit to pay for the next months rent. I didn't care and forfiting the deposit and moved out. So, I came home to my new place and they mailed a letter charging me with the remainder of the rent. I don't have it. When I last talked to one of the managers over the phone I asked if we were all square and she said yes. So, I know it is my fault for not giving a 30 day notice but, I struggle to make it now and don't have it. Do I have any options? Can they sue for the remainder of the rent? Or am I doomed?

    What is "the remainder of the rent" you speak of.

    Actually you need to give up what state this involves. Also, did your lease require a 30 day notice?

    As well, you didn't give a very good time line. As I read it you moved out before you actually started your month to month tenancy. Correct?

    and if you owe the old LL anything, of course they can sue you for it.

    I am from California. They do require a 30 day notice. I know they can sue. The remainder is 800. I guess my question is do I have any recourse seeing I don't have any money to pay them.

    No, you either owe the money or you don't.... It doesn't matter that you don't have it.

    If you believe you do owe that much, then try to negotiate a payment plan.

    They don't have to agree to it, as they could sue and try to win a judgment against you, but they may agree to it.

    Look, I am well aware it doesn't matter weather I have the money or not. That is elementary. I thought this was EXPERT LAW. Please leave the matronly patronizing advice aside. I am looking for solutions from experts. Amateurs need not respond. Thank you for your kind help

    I see, you want somebody to tell you there is a way out of paying. Of course there is; bankruptcy if available to you and your death. There are other illegal methods but it would be unethical to offer any of those.

    As happy suggested, you could try to negotiate to lessen the blow.

    other than that you're SOL and that has nothing to do with statutes.

    good enough?


    btw, it is expert law, not "never never land" or "the guild of magicians." Deal with the reality,you owe and you will have to pay someday.

    If you thought I was looking not to pay then you are blind to the truth my friend as I never eluded to escaping my responsibilities as you suggest. . I was looking at my options seeing I made a costly mistake due to my ignorance of the law and failed to give enough notice. I am grateful at any advice or understanding I may be enlightened with. I am sorry if I was rude towards Happy and I owe you all and amends for that.

    Thanks for your help. Sorry again for allowing my fear to get the best of me. I will call and see if I can make things right.
