    Default Is a Tenant Responsible for Breaking a Renewed Lease if They Didn't Sign the Renewal

    My question involves landlord-tenant law in the State of: Calif
    my wife and I signed and finished a 12 mo lease on a rental home in calif, the landlord wanted to renew a 12 mo lease
    and my wife did not because she did not agree with it, the landlord gave us a new lease in both our names.
    I signed it , my wife did not sign it, I gave it to the landlord unsigned by her,
    is my wife responsible for clean up bills once we move out?

    I'm going to guess yes.

    CA is a community property state and it's possible that your signature is all that's required to bind both of you to the lease provisions.

    I don't have the time to research that issue. You might do some creative googling or wait until one of our CA people respond. Or consult an attorney.

    why didn't your wife sign the lease?

    it's an odd question you ask; would your wife be responsible for the clean up costs.


    does that suggest you intend on not paying them yourself? Did you and your wife both live in the apartment?

    my wife and I split up is why she did not sign the lease, because she was not going to be living with me the next 12 mo so she did not sign.
    but she had her personal things at the rental, she went to live with her daughter and let me keep the furniture with me until the lease was up, I moved out at lease end, the landlord kept our security deposit and billed her not me for more fees above the security deposit, I left the rental in clean condition and did no damage, it is made up stuff to collect money.
    my wife moved out of calif, now she is being sued in small claims court in her new home state for damages by the calif landlord.
    She has a good job, i am unemployed.

    A lease for more than a year must be in writing, so it's quite possible that your spouse is orally committed to the one year lease; depending on other facts she may also be bound by part performance. But your landlord doesn't have to go after her for anything, if he chooses instead to recover for his losses and damage from you.
