My question involves labor and employment law for the state of: Washington regarding school employees.
I'm so glad I found this web page! I'm part of a parent group who is trying to do the impossible task of keeping our school board honest.
Long story short - Our school district hired in interim superintendent without a full and open search. He was hired less than a month after the job was posted. Here is some wording from the job posting: "The ____ district is conducting a search for an interim superintendent for one year (during which time, the District will conduct a search for a permanent Superintendent)" Our board has promised the community a search for over 3 years. The last interim superintendent was hired full time in an illegal secret meeting but has since retired.
Here is my two part question:
First - Since the interim superintendent's contract does not state the possibility of the job turning into a permanent position, doesn't the school district legally need to open up the position of superintendent? Once opened do they have to follow their procedures which include opening the position to the public?
Second - What are the repercussions, if any, for a school district ignoring their own hiring procedures?
