    Default Contracting Without a License in California

    My question involves criminal law for the state of: California

    Hi all,

    according to California's law "Those who are caught contracting without a license likely will have to appear before a Superior Court judge to answer to misdemeanor charges that can carry a potential sentence of up to six months in jail and/or a $5,000 fine, as well as an administrative fine of $200 to $15,000." Can I still be cited if I tell the homeowner/police officer that I am an unlicensed contractor. So lets say for example, I went to give a bid for a homeowner (It's a sting operation) and I tell the undercover home owner that I am not licensed and if he is ok and still wants me to do the work. Can I still be cited for that? Or if I ask the undercover home owner " Is this a sting operation? Can they legally lie to you and give you a citation?

    Contracting without a license is the same if you tell someone or if you hide it from them.

    The police can legally lie to anyone and everyone, however, it is a crime if you lie to a police officer.

    You violate the California contractor licensing law the insistent you represent yourself as a contractor if you do not have a license. You can't advertise, go out on estimates, or even meet with a potential client.

    I didn't violate any law or get cited for contracting without a license. Just asking to make sure I don't get myself into trouble.

    Oh by the way,

    In California, you are allow to do the work as long as it is below $500 in labor and material and you are allow to advertise as long as you stated that you are not licensed.

    "All businesses and individuals who construct or alter, or offer to construct or alter, any building, highway, road, parking facility, railroad, excavation, or other structure in California (other than federal projects located in California) must be licensed by the CSLB if the total cost of labor and materials under one or more contracts on the project is $500 or more."

    So you're not a contractor as you originally said. Just a handyman.
