    Default Marriage and Taxes

    Greetings,

    I came to US in 1999 on a student visa. Then got my OPT in 2004. That one expired in 2005. I have been in the States without a status for more than 6 months.
    So i have two questions:

    1. Can I marry my girlfriend who is a US Citizen (was born in the US) and then adjust my status?

    2. If she applies for me through us getting married, do I need to have tax forms? I did not pay taxes for last three years or before. I am a tennis coach and I get personal checks or cash.

    I would really appreciate any help.

    You can marry her then petition to adjust your status. I can't guarantee results.

    Committing tax fraud is perhaps not the best approach for somebody to take, if their goal is to immigrate. If the IRS or USCIS are not likely to figure out that you owe taxes, you can probably immigrate without reporting the income if your fiancée has sufficient income or a cosponsor. If they are likely to figure out the tax fraud... consult an immigration lawyer.
