    Default Repercussions for Missing a Court Date

    My question involves a marriage in the state of: Ohio

    My dissolution is on it's last leg hopefully. My husband and his attorney have been dragging this out for much longer than it needed to be. My attorney notified me weeks ago about taking a court ordered co-parenting class that must be completed by our court date, which I have already done, and the date that we are to be in court, which is the first week of December. We both also have recieved the court order for the class in the mail, although the notification about the court date was given to me by my attorney.

    My husband informed me that his attorney hasn't told him any of this, including that we even have a court date set up for the first week of December. What will happen if he doesn't show up but I do? Can the divorce be granted anyways since we both have already signed the paperwork for the seperation and the shared parenting? If not, and there is a continuance, would I be able to be reimbursed my attorney fees, and even lost wages since I have to take off work to be there? Are there any other reprecussions for not showing up to a court date? Or to not having that court ordered class completed by the court date?

    I have done everything right from the begining of this, both being fair for us, and most importantly making it as easy and fair as possible on our daughter, and he just keeps blocking me every step of the way. All he cares about in the divorce is the money, so he might start playing more fair if he knows that he will end up paying more money by not showing up. Any info you can give me will be apprecitated.

    You need to pose this question to your lawyer.

    If in fact you have a fully prepared and executed stipulation for a divorce judgment, and the purpose of the hearing is for the entry of that judgment, then it should be possible to proceed with the hearing necessary to enter that judgment based upon the presence of only one party.

    Yes, I emailed my attorney this morning and explained the situation. He said that he was going to call my husband's attorney, and then get back to me. I thought of these questions after getting off the phone with him, but I thought since they were generic that perhaps they could be answered here, which would ease my mind while waiting the week to ten days it normally takes for my husband's attorney to respond to mine.

    Mr. Kia. Thank you for your response. It is helpful, and gives me hope that this awfulness may not continue indefinitely. We do already have everything signed and it is just for the entry, thank goodness, so perhaps my other questions weren't necessary, however, in case it can't go thru that way, are there repercussions for not showing up to a court date in Ohio? Or for the first offense of disobeying a court order if he were to not complete the class by the time we go to court? Is it reasonable to ask that he pays my attorney fees in the event that my attorney and I show up, but he does not, and we have to wait for another date?

    If your ex- received proper notice of the hearing, and it is necessary to adjourn the hearing due to his not being present or due to his non-completion of the court-ordered class, you can ask that your lawyer request that the court grant sanctions.

    Can you tell me if it is concidered proper notice for the attorney's in the case to be notified, and not have anything sent to my husband and I directly from the courts? I recieved notification of my court date from my attorney, but my husband is saying that his attorney hasn't contacted him at all.
