    Default Mailing Surplus Medication to Another Person in Another State

    My question involves workers compensation law for the state of: New York. A friend of mine who is on Disability and Medicaid has been mailing her surplus pain killer medication to he daughter in another state. She seems to think there is nothing wrong with this, I've been telling her she could face some pretty serious consequences if she gets caught. Can anyone tell her what penalties she will face if she gets caught.

    If we're talking about a controlled substance, the consequences of her actions could include state or federal felony charges. Charges could result for other prescription medications, as well, but for a pain medication that is a controlled substance the odds of a prosecution increase significantly.

    If it requires a prescription, it might be a misdemeanor for the recipient depending on the state, might be worse.

    I agree that it might be felony charges for your friend and that could mean jail.

    It could very much be a felony. It's called distribution of a controlled substance. Even if BOTH parties had a prescription for the drug. Even at the lowest level she could be convicted of a federal crime $100,000 and a year in jail. It goes up from there.

    Tell her to call the US Postal Service and ask the postmaster. They'd be happy to tell her.

    The transfer of a prescription drug to anyone other than the person for whom it was prescribed is illegal under federal law. The penalties will significantly more severe if the drug is a controlled substance. I’ll also note that she’s potentially doing her daughter harm by what she’s doing. Only a doctor can determine what prescription medication the daughter ought to take. The drug she is giving her daughter may be inappropriate for her daughter and could endanger her health.

    Finally, she better hope that her daughter isn’t selling this drug to others. If your friend gets implicated in selling drugs, she could end up spending a significant time in prison.

    Thank you for all your quick responses. Her daughter is known addict \ dealer. I'm washing my hands of the whole matter. It's been all over Facebook that the woman not the daughter stole the medications from a woman dying of cancer. I'll let Karma take it's course.

    If they're stealing/redirecting/absconding with meds needed by a "woman dying of cancer" I would do everything legally within my means to ensure that this activity stopped, and the perpetrators were dealt with in a (legal) manner befitting the offense!

    But that's just me! Or rather, my conscience.

    State and Federal charges can mean mandatory prison sentences. Also if they get charged federally,the feds are very strict,known to hand out extremely long prison sentences.
