Depending on the state, statutory rape may be completely off the table.
And that's not quite accurate either.
Basically, the state determines at what age you are mature enough to know what sex is, know if its a good idea, etc. So if the legal age for example is 18, if the girl got pregnant at 16, the state would consider it rape even if she said yes, because the state believes she is too young to really know what she is agreeing to, while the 24 year old knows exactly what he's doing, so they would try to say he took advantage of her.
