My question involves a consumer law issue in the State of: ca
Disputing credit card charges. The question is which position is the better one to take.
Here is the situation to make a long story short. I was traveling in china. I book 3 night hotel room on line, through a booking agency. They said the room has to be pre-paid to get a certain rate. I paid in full through pay pal. And I got a receipt saying there are not cancellations and I will be charge if I show up or not.
When I got to the hotel they hotel said my the booking agency canceled my booking. The booking agency said they cancel my booking because they cannot guarantee that my room was going to be non-smoking because I requested a non smoking room (the cancellation was during the time I was traveling). It took at least 2 hours to get to this point when I got to the hotel. The booking agency said I had to rebook with them. So I did I gave them my credit card info again and they said everything was fine the card went through.
The hotel will not let me check in until they got the conformation from the booking agency. So we waited another 1 hours. And we finally call the booking agency . They said need me to sign a authorization for the charges. I said why did you tell me that the last time I booked the room. I complained and said also my prepaid room should not have been canceled in the first place. They said they were going to give me a discount. When I said how much they said I would be happy with it. So I figure since I was staying there 3 night I would get 1 night free.
When the authorization came it said I agree to paid zero (0.00). Great discount, right. It is the 5th hours know since I got to the hotel, it seem reasonable to me. I was very tire at this point. I was traveling all day, did not have dinner, could not take a shower, go to the bathroom ect.
The problem is that they are charging my credit card the full amount.
So the questions is what I should dispute. So I dispute the entire amount. Since I agree to paid zero. Or should I dispute what discount I think is reasonable, since they said they will give me a discount and "I will be happy with it" . I figure this to be one night free.
Even if neither is a strong case. The questions is what is the stronger legal case to take.
thanks
