    Default Colliding With a Vehicle Pulling Out of a Parking Space

    Hello,

    I am quite curious to know who is at fault in my situation of a car accident.

    What happened was there was 2 lanes. I was in the left lane but changed to the right lane because it was empty and the left lane had cars, however, a street parked car from the right side tried to pull into the lane also at the same time which hit the side of my car with its left side bumper. This accident caused damaged to my whole right side of the car. The other car bumper came off.

    Was this my fault or the other cars fault? I was already going about 25 mph and changed lane without violating any traffic laws in California and in no way could have known or seen the parked car tried to pull into the lane as it came from my right side.

    The hit on the right side of my car is from the right side of the bumper all the way down my right side doors to the end of my right side rear bumper.

    Both your faults. You made an improper lane change as it was not clear. They pulled out into the lane before making sure the enough clearance to do so.

    Not sure I agree.

    Seems to me that the OP had already completed a successful lane change when the parked car pulled out and hit the side of his car.

    Without knowing the full facts or layout of the road, I'm going to take some issue with that first response. Responsibility will depend upon factors including what each driver observed, or reasonably should have observed, before making their respective movements. A driver in a regular traffic lane is not charged with predicting every movement that might be made by vehicles parked along a street -- ordinarily, he has right of way and it is the responsibility of the parked vehicle to yield.
