    Default Receiving Stolen Goods Charges

    My question involves criminal law for the state of: ca
    "friend of mine on probation was arrested for receiving stolen goods. They were shipping containers found next to a trash can dumpster. No idea this was illegal..i have never been in trouble w/ the law ever...the containers are mine and so I'm most likely going to let the court know this today as a matter fact.... friend is being charged probation violation and receiving stolen property. Am I going to be charged as a felony or misdeamonor? and am I looking at jail time and est. worse case scenario how much jail time?

    What do you mean by "the containers are mine"? Are they actually your containers or are you the one who took them in the first place? Do you have any kind of criminal record?

    yes well we were found them together and took them together but I use to live w friend and I had my personal belongings stored in the 7 containers...other then a pair of shoes which are his...I don't have any criminal record

    How did it come about that anyone realized you had broken the law and took action on it? Unfortunately the fact that you were together when you took them isn't going to help your friend.

    Before you do anything else, you need to talk to a criminal defense lawyer and share the full facts of the case, and then follow your lawyer's advice.

    So your story is that you both committed the crime and thus your confession would result in your being convicted along with your friend, not instead of your friend.

    Which is to say, you moved out and left the containers with your friend -- with his knowing where the containers came from, and being in actual possession of the containers.

    And it was obvious upon casual observation that these shipping containers were stolen?

    nothing... I thought they were trash. they were next to a dumpster.

    on the side it says property of rite aid unauthorized use punishable by law but labels were covering that notice and honestly I never paid much attention to them anyhow . they were stored in a storage unit before brought to place of residence
