When you file SS8 you should also file for unemployment compensation in your state independently of the SS8 at the federal level. Those are two different determinations but one could help the other. I have won an SS8 determination as well as unemployment. I didn't even have a lawyer and I won. If you worked on the employer's premises and had a supervisor who gave you work assignments, you should be able to win.

You only owe the tax based on being an employee. I do not see how tax you don't owe would be included in a bankruptcy.
