    Default Getting Emancipated in Order to Bypass Work Permit Restrictions on Job Hours

    My question involves juvenile law in the State of: Michigan
    I currently am 17, and a dropout. I dropped out to pursue my GED, and have been talking to an adviser from Michigan works about this. My main reason for pursuing emancipation is to get more hours and not need a work permit (currently I am only allowed 24 hours while school is in session, although I do not attend, and a GED, or emancipation would be my only way to get passed this). My problem is I have housing setup in December (have not signed the lease but the apartment has been saved for us). I believe I am financially stable (ever since having a job i've been smart with my money, and have helped my parents numerously times financially. My mom and my father (separated) are both fine with the idea (my father is upset, but says it is my decision,but refuses to sign anything, and wants to talk to the judge first). My problem is seeing all these posts about a slim chance of emancipation I'm kind of scared, I mean I don't understand how a minor can live off of 24 hours a week? I plan on sending in my last few paystubs, and a printout of my bank balance. I also plan to write out a page for proving I am financially stable, and a separate page discussing how I manage my social and personal affairs. I have no idea what else I should provide, and can an unemployed nurse sign my affidavit, she WAS my doctor's nurse, but my doctor went to jail... haha... so suggestions? (Would i also be better off waiting till december and applying AFTER I move out?)

    There hasn't been a minor yet, in any state, who was emancipated so that they could do something. Emancipation is based on the here and now, not the future.

    A drop out who does not yet have his GED and who is not earning enough to support himself will not be emancipated. A judge is not going to emancipate you because *maybe* you will then be able to work more hours.

    In general, emancipation does not make other age-related laws go away.

    Or turning 18. But perhaps you should focus on getting that GED at your earliest opportunity.

    As cbg says, emancipation is about what you can demonstrate when you go to court, not about what might happen in the future. Although it will be December by the time you get before a judge, if you can't afford the apartment you won't be able to prove that you have housing.

    You may well be able to prove that you're sufficiently financially stable to do whatever it is that you're presently doing with your money, but that's not what you need to prove to the court. You need to prove that you're able to support yourself, and you are telling us that you cannot do so based on your present earnings.

    How do you plan to obtain the apartment and move out in December if you cannot afford the lease due to the limits on your hours?

    I did not say I can't support myself on what I'm making right now, I'm just saying I'd prefer not to be super strapped on cash when I move into the apartment. Either way I can afford it, although I'd prefer to make more money and able to keep some in my savings. My budget is set on what I make right now, not what I plan to make. My GED is my main priority, but I can not get that within the next few months, so its not in my short term arrangements. What form would I use to prove my parents agree? I heard they could sign something about them agreeing, and wishing to opt out of the hearing.

    You killed any chance at proving you are capable of affording emancipation when you used the word US in describing how to pay the rent.

    if you get as far as filing for emancipation, your parents will be required to come to the hearing at the court for this. That is where your father will be asked his opinion on the emancipation.

    as to filing before or after moving out; this is from the statute addressing emancipation and the hearing before the court:


    (e) That the minor has the ability to manage his or her personal and social affairs, including, but not limited to, proof of housing
    .
