My question involves an eviction in the state of: Virginia
Hello so my landlord terminated my lease because she said my son made too much noise. she then gave me 2 months to find a new place. i was supposed to be out on 8/29. on 8/1 my rent check bounced this was the first time this had happened. I told her I would get the rent to her immediately I had an emergency that could not be avoided. so after 5 days I still did not have the rent so she gave me a five day notice. i didn't have the rent in 5 days so she started the eviction process we went to court around the 7 or 8 of sept I had still not left the apartment so she gave me another eviction notice for a court date set for the 18 of sept. On sept 1st I paid the back rent I owed so we went to court and when the judge found out I already paid her she calculated the court fees check fee she then asked me about the other eviction notice i told her i was looking for a place she asked me when i could be out i told her by the 12th of september so she calculated the days i would be there she then told me what I would owe which was 403.00 that I could pay on oct 1 We agreed I paid on the first and I was out of the apartment on the 12th after walk through with landlord and gave her the keys. found a new place around the 20th i sent her my new address and asked when i could be expecting my 700 security deposit she ignored my email after that I wrote her about 3 more emails and sent her text messages she ignored them all. last week i told her i knew she had 45 days to give me my security deposit and that she had 3 days until the 45th day and that i would take her to court she then text me back that I was not getting my security deposit because i was evicted and it was called holdover. I looked up holdover and if I owed her any money I could understand her keeping my 700 dollars but i didnt owe her anything and why do a walk through if you had no intention of giving me my security deposit back and why ignore me for over 30 days if you had the right to do this. I jsut want to know can she do this and is there anyway to fight it. I am a single mother in school and medically retired from the navy I do not have a lot of money and to me 700 dollars is alot of money please if you had any knowledge on what I should do please help.
